Online terms and conditions Team Nijhof Youngster Market

  1. Team Nijhof Youngster Market is organised by Team Nijhof VOF, located at Kulsdom 9, 7274 EG Geesteren, the Netherlands.
  2. Participation in this online breeders' market means the express and unreserved knowledge and acceptance of these terms and conditions of this sale.
  3. The Buyer must register via the Team Nijhof Youngster Market website before he can place bids.
  4. The horses will be sold in the condition they are in at the time of the video recording day.
  5. Buyer pays only the horse with no additional purchase costs (except VAT - if applicable). Purchase price does not include 21% VAT. Additional x-rays will be charged. 
  6. Seller shall give Bidder the opportunity to view horses offered for sale prior to a sale, by appointment at Seller's premises if desired, exclusively on request. 
  7. The sale is concluded under Dutch law by acceptance of the bid by the Seller and after payment of the invoice amount.
  8. Bids and payments are made in euros (€).
  9. Buyer agrees to pay for the horse if it is the highest bidder. It is not possible to withdraw a placed bid.
  10. The Seller has 24 hours to accept the bid or make a counter-bid. After these 24 hours the bid expires.
  11. An offer for a horse accepted by the Seller results in a binding contract. The Buyer undertakes to actually complete the sale. By making a bid, the bidder undertakes to pay the invoice amount. The purchase price is calculated by adding any applicable VAT to the sale price. If the horse is sold abroad, it must be provided with export documents approved by an NVWA veterinarian. Team Nijhof Youngster Market will provide these export documents. The costs will be invoiced to the Buyer. The total will be the invoice amount.
  12. The purchase price is due immediately upon allocation of the horse. As soon as the Seller has accepted the bid, the Buyer will receive an invoice with the amount payable and the Seller's details.
  13. Any liability in respect of the horses sold passes to the Buyer 5 days after acceptance of the bid. The legal agreement is directly between the Buyer and the Seller, with the understanding that with regard to the Buyer, not Team Nijhof Youngster Market, but the Seller is not liable for any shortcomings that the animals may show after the sale.
  14. At the time of payment of the invoice amount by the Buyer to the Seller, ownership of the horses will pass to the Buyer.
  15. After the total invoice amount has been transferred to the Seller's account number, delivery will only take place after mutual agreement with the Seller. Transport costs outside the Netherlands shall be borne by the Buyer.
  16. Unless otherwise agreed between Team Nijhof and the Buyer, the horse will be collected by the Buyer at the owner's location. The actual delivery of the horse shall in any case take place within fourteen (14) days after the Buyer has paid all amounts due to Team Nijhof. After these fourteen (14) days, the seller of the horse will be entitled to charge the Buyer for stabling and care costs. 
  17. If the horse is sold abroad, it must be provided with export documents approved by an NVWA veterinarian. Team Nijhof Youngster Market can provide these export documents. The costs will be invoiced to the Buyer.
  18. Neither the Seller nor the Buyer can derive any rights from the fact that the Team Nijhof Youngster Market has selected the horses and they have been subjected to a veterinary examination if desired.
  19. The information given about the horses offered for sale is only intended to give an impression of the qualities of the horses without pretending to be complete and without any guarantees. When describing horses on its website, Team Nijhof Youngster Market is dependent on the information provided by a seller or third parties. Team Nijhof Youngster Market will not be liable for (printing) errors and/or mistakes on its website and in the online sales catalogue.
  20. The horses offered at Team Nijhof Youngster Market have been clinically and radiographically examined. The X-ray images and clinical reports made in that context can be requested by anyone on the website. 
  21. In the event of export within the current year, the buyer will produce a valid export document, under penalty of still being charged the VAT due.
  22. In case of a dispute between parties, the court of Zutphen has exclusive jurisdiction. Any dispute arising from this online breeding market and its consequences shall be governed exclusively by Dutch law.
